Signing of the contract for the construction of aircraft engine service center in Środa Śląska

The Management Board of Budimex announces that, on 1 August 2017, Budimex SA signed the contract for the construction of aircraft engine service center in Środa Śląska with XEOS Spółka z o.o.

Contract value: PLN 120,598,800 net.

Works commencement date: 1 August 2017

Work completion date: 5 November 2018

Basic guarantee period: 60 months (120 months for roof tightness)

Advance payment: 15% of net remuneration.

Payment terms: 30 days from the delivery of a correct invoice to the Employer.

Bank performance bond for the construction period: 10% of the net remuneration.

Contractual penalties paid by the Contractor:

- 0.2% of net remuneration for each day of delay for failure to meet the completion date,

- 0.1% of net remuneration for each day of delay for failure to meet the milestones,

- 0.05% of net remuneration for each day of delay for failure to remove defects during the guarantee period,

- 0.05% of net remuneration for each day of delay for failure to implement Contract Engineer’s orders,

- 10% of net remuneration for contract termination due to Contractor’s fault,

- 0.1% of net remuneration for each instance of breaching confidentiality requirements,

- 0.1% of net remuneration for each day of delay for failure to complete replacement works,

- PLN 2,500,000 - additional penalty for failure to meet the completion date,

- PLN 10,000 for each day the works at site are performed without the supervision of appropriate discipline works manager,

- PLN 10,000 for each instance of failing to implement supervision inspector’s order,

- PLN 20,000 for each day the works at site are performed without the supervision of the construction site manager,

- PLN 20,000 for each instance of failing to meet contractual obligations.

Maximum liquidated damages that may be charged to the Contractor: 20% of the net remuneration.

The Employer reserves the right to seek damages under generally applicable rules if the amount of loss sustained exceeds the amount of the stipulated contractual penalty

The bid value exceeds the threshold of PLN 111,446 thousand.
