New route for national road no. 21 in Słupsk - new contract for Budimex Budownictwo Sp. z.o.o.

The Management Board of Budimex announces that on 25 April 2014 Budimex Budownictwo Sp. z o.o. (a wholly-owned subsidiary of Budimex S.A.) signed a contract for "Performance of construction works within the project 'New route for national road no. 21 in Słupsk'" with Zarząd Infrastruktury Miejskiej (Urban Infrastructure Management) in Słupsk.

• Contract value: PLN 88,944,228.37 net
• Commencement date: handover of the construction site will take place within 10 days from the date of signing the contract
• Deadline: 20 months from the date of signing the contract
• Guarantee period: 3 years
• Financial terms and conditions:
  • Advance payment: 10% of the gross value of works
  • Payment: 30 days after the Contracting Authority has received an invoice
  • Performance bank guarantee: 10% of the gross contract value
• Penalties payable by the Contractor:
  • 20% of the gross remuneration for the Contracting Authority withdrawing from the contract for reasons attributable to the Contractor,
  • 0.1% of the gross remuneration for each day of delay in performing the subject matter of the contract,
  • 0.1% of the gross remuneration for each day of delay in removing defects discovered during the acceptance procedure during the guarantee and warranty periods,
  • 0.1% of the gross remuneration for each case of a failure to pay remuneration due to sub-contractors.
• Penalties payable by the Contracting Authority:
  • 0.1% of the gross remuneration for withdrawal from the contract for reasons attributable to the Contracting Authority
• The Parties reserve the right to compensation which exceeds the amount of contractual penalties to the amount of damage actually suffered

The value of the contract exceeds 10% of the equity of Budimex SA.
