Conclusion of a Bank Guarantee Agreement with Banco Espirito Santo de Investimento S.A.

The Management Board of Budimex SA reports that on 2 September 2012, the company received from the Polish Division of Banco Espirito Santo de Investimento S.A. a copy of a credit facility agreement signed by the bank and by Budimex.
Under this credit facility agreement, Budimex may order the bank to issue bank guarantees of up to a total sum of PLN 80,000,000. The agreement has been concluded for the period up to 10 July 2013.
As security of Budimex performing its obligations under the credit facility agreement, Budimex made a representation on submission to bank enforcement under the provisions of the Polish Banking Law Act.
The other terms and conditions are standard for this type of agreement.
The value of the agreement exceeds 10% of the equity of Budimex SA.
