Construction of a warehouse with its associated infrastructure in Belsk Duży - a new contract for Budimex SA

With reference to current report no. 67/2014 of 14 August 2014, the Management Board of Budimex SA announces that on 14 August 2014 the Company also signed a contract with Ferrero Polska Sp. z o.o. with its registered office in Warsaw for building a warehouse with its associated infrastructure in Belsk Duży.

• Contract value: PLN 68,700,000.00 net
• Commencement date: once the construction site has been handed over
• Work completion date: 20.07.2015
• Warranty period: 5 years for building construction and roof weatherproofing; 3 years for other works
• Financial terms and conditions:
  • Advance payment: 30% of the net contract value + VAT
  • Payment: 30 days after the Contracting Authority has received an invoice
  • Performance bond: 5% of the gross contract value
• Maximum amount of penalties: 10% of the contract net value

The Parties are entitled to claim damages on general conditions, where the amount of damages exceeds the stipulated contractual penalty.
The value of the contract exceeds 10% of the equity of Budimex SA.
