Continuation of construction of the A1 Motorway - information about the selection of the Budimex SA bid

The Management Board of Budimex SA announces that on 29 August 2014 it was informed by the General Directorate for National Roads and Motorways on the selection of the bid placed by the consortium of Budimex SA (consortium leader with 95% share) and Ferrovial Agroman SA (consortium partner with 5% share) with its registered office in Madrid as the most favourable bid in the proceedings for awarding a contract under an open tender procedure for the "Construction of the second roadway within Międzyrzecze bypass road along the S3 expressway from km 0+000.00 – 6+370.00".

• Contract value: PLN 83 648 989.19 net
• Commencement date: date of the contract.
• Finish date: 22 months from the commencement date. Winter periods (i.e. between 15 December and 15 March) shall not be included in the completion deadline.
• Guarantee periods: 10 years.
• Financial terms and conditions:
  • Advance payment: 5% of the approved gross contractual amount
  • Payment: 30 days after the Contracting Authority has received a VAT invoice
  • Performance bond: 10% of the approved gross contractual amount
• Maximum penalties payable by the Contractor:
  • 20% of the approved gross contractual amount
• Penalties payable by the Contracting Authority:
  • 15% of the approved gross contractual amount for withdrawal from the agreement for reasons attributable to the Contracting Authority.
• The Contracting Authority reserves the right to claim supplementary compensation which adjusts the amount of contractual penalties to the amount of damage actually suffered and lost profits.

The contract value exceeds 10% of the equity of Budimex SA.
