Requirements with respect to occupational health and safety, fire protection and environmental protection that should be taken into account in the proposal

All works at the construction site have to be carried out in compliance with requirements of legal regulations and with internal requirements of the Safety and Health Protection Plan (SHP Plan) and standards of the General Contractor – Budimex SA. Requirements set in the document supplement requirements arising from legal regulations. The price offered by a subcontractor or a supplier have to take into account all costs associated with meeting the requirements for occupational health and safety and environmental protection.

 The manner of fulfilment of individual duties and requirements as well as related costs may be subject to arrangements at the stage of negotiations and selection of the Contractor.

1. Work planning

 

1.1. Assessment of professional risk related to the performance of the subject matter of the agreement (task risk assessment, APR)

 

Every contractor shall be obliged to assess risk for works that are going to be entrusted to this contractor under the agreement.
The assessment shall be made taking into account the planned technology of work. The study has to take into account specific technical and organizational solutions available to the contractor or that the contractor plans to introduce in the process of the works execution. The results of the task risk assessment are essential for the proper preparation of the proposal and the Instruction of Safe Execution of Works (ISEW). The assessment of professional risk for the task supplements the assessment of professional risk and is the first stage of planning of safe works execution.

 

1.2. Instruction of Safe Execution of Works (ISEW)

 

The purpose of the ISEW is to plan and prepare the work process in a way allowing for its safe performance. This document includes all safety-critical aspects, i.e. technical, organisational and human aspects (TOH).

 

1.2.1.  Instructions of safe execution of works are required for the following types of works:

 

  • works at heights,
  • works entailing a risk of people burial under earth falls or other loose materials, including inter alia earthworks related to narrow and wide excavations,
  • works involving a risk of contact with chemical or biological substances constituting a danger to human safety,
  • works carried out in direct proximity of power lines and gas lines,
  • works carried out in direct proximity of an area with passing vehicular traffic,
  • works involving the assembly and dismantling of heavy prefabricated components,
  • works requiring an employee’s presence in direct proximity (work zone) of mobile construction machines,
  • works in lift or installation shafts and other spaces with limited or hindered access for technological reasons,
  • transport works involving the use of fixed and mobile lifts and cranes,
  • works involving the use of devices/baskets in place of work platforms,
  • works involving the use of explosives,
  • works carried out on the banks of watercourses,
  • other works recognised as especially hazardous by the Construction Site Management, recorded in the SHP Plan.

 

1.2.2. Rules for drawing up the ISEW:

 

  • The Instruction of Safe Execution of Works (ISEW) may be an unified document concerning particular construction works or as a set of instructions for safe performance of work, when it pertains to complex construction works, comprising various actions and activities involving a high or medium risk.
  • The ISEW should include only elements that are materials from the point of view of achieving its objective. Any information unnecessary from the point of view of the user, resulting only in a lack of transparency of the instructions, should be avoided.
  • The instruction should be clear and comprehensible. Information should be expressed in a simple way, without leaving any interpretation doubts or space for the interpretation. Wherever possible, information should be presented in form of diagrams, photographs or drawings.
  • The following information and documents provide a basis for drawing up the instruction:
    • SHP Plan,
    • assessment of professional risk for the task (APR),
    • design documentation, including the detailed design, technical specifications,
    • work schedule,
    • construction site organisation plan,
    • technical and operating documentation of machines and equipment, operating instructions, safety data sheets of chemicals, etc.,
    • guidelines included in regulations, procedures and standards,
    • information on the OHS coordination pertaining to work processes carried out in direct proximity of works planned.
  • The approved and accepted ISEW is a condition for starting the performance of works. The Instruction shall be approved (signed) by an authorised person representing the Contractor. The Construction Site Manager representing Budimex SA or a person appointed by the Manager shall accept the document approved. The acceptance shall be confirmed in writing.
  • The ISEW can be modified or updated in line with the needs of the construction site or the technology process. The approval and acceptance procedure is the same in each case.

 

2. Organisation of work safety and environmental protection

 

2.1. Organisation of work and supervision over its correct implementation:

 

2.1.1. The Contractor shall be obliged to ensure continuous supervision over employees and works carried out by them, a person with the qualifications required by the labour law, i.e. the person managing works within the meaning of the Labour Code.

 

2.1.2. In the case of the execution of construction works, the Contractor shall be obliged to ensure direct supervision by persons having relevant building authorisations. The person having building authorisation, who completed the training for persons managing employees, may simultaneously organise and exercise the supervision described in section 2.1.1.

 

2.2. The Contractor shall be obliged to ensure the supervision described in sections 2.1.1. and 2.1.2, at any time during the performance of works.


2.3. During the performance of works, the Contractor shall be obliged to ensure the continuous presence of persons appointed as responsible for first aid and trained in this respect. This is the duty of every employer or organiser of work.


2.4. During the performance of works, the Contractor shall be obliged to ensure the continuous presence of persons appointed as responsible for firefighting and evacuation of employees from the place of the work performance.


2.5. The Contractor shall be obliged to provide supervision and advice with respect to OHS, by a qualified OHS service or persons with appropriate training and authority (employer, person entrusted with the duties in accordance with applicable law). OHS supervision shall cover all employees and persons involved in the performance of works. The person in charge of the performance of tasks of the OSH service shall be obliged to inspect workplaces and to document the activities carried out taking into consideration irregularities detected and corrective activities recommended.

 

3. Preparation of employees for the performance of work

 

The Contractor shall be obliged to carry out the work using employees and persons fully capable to perform tasks entrusted and having necessary qualifications and authorisations. The capability to perform work and the qualifications shall be documented on an individual basis for each employee, taking into account his/her position and works entrusted.
 Documents confirming authorisations and qualifications include:

 

  • current medical certificate confirming the lack of contraindications for work issued by a physician entered in the register of physicians performing preventive medical examinations, kept by the voivodeship occupational medicine centre (in the case of employees – foreigners from EU countries, translations of medical certificates by a certified translator are acceptable);
  • current regular training on occupational health and safety. In the case of blue-collar employees, the training shall be updated at least once a year, while in the case of employers and persons managing employees, the update shall be required at least every 3 years;
  • documents confirming additional qualifications (if they are required to perform works entrusted, e.g. the excavator operator licence, scaffolding assembly authorisation, etc.). The person performing work should have these documents at the workplace.

 

The inability to present the documents shall be treated as a failure to meet the aforementioned conditions and shall result in forbidding the employee to perform work or removing the employee from work.

 

4. Work clothes, work shoes and personal protective equipment

 

4.1. The Contractor shall be obliged to provide employees with working clothes and safety footwear, at least S3 type (and showing the additional properties in the case of positions, such as the welder, electrician, etc.) as well as the personal protective equipment appropriate for hazards identified (APR, section 1.1.).


4.2. Regardless of the measures selected taking into account the work performed, the basic equipment of an employee and any person present at the construction site includes:

 

  • working clothes covering arms and legs,
  • warning vest complying with PN-EN 471 (2nd visibility class), with a mark allowing identifying the Contractor,
  • safety footwear protecting the ankle, meeting the requirements of S3 category, complying with PN-EN ISO 20345,
  • protective helmet complying with PN-EN 397 (valid colours: supervisory staff – white, riggers – red, other employees – any colour),
  • protective goggles, class minimum 1F, complying with EN 166,
  • in the case of cutting with angle grinders – face shield adjusted to the helmet,
  • other requirements set by the Construction Site Management and described in the SHP Plan.

 

4.3. The aforementioned personal protective equipment should be provided both to employees performing work and to persons present at the construction site. This obligations shall apply to all people, regardless of the type of work performed or purpose of the visit.


4.4. All personal protective equipment used at the construction site has to:

 

  • be visibly marked with the CE sign and protection class,
  • be used within the validity/durability period set by the manufacturer,
  • have documents confirming checks performed, as required by the manufacturer,
  • be in good technical condition,
  • be properly clean.

 

4.5. The type and quantity of personal protective equipment and the costs related thereto should be determined on the basis of the APR and the number of employees and persons who will perform the work or be present at the construction site.

 

5. Works that should be performed by at least two persons

 

The Contractor shall be obliged to identify works that should be performed by at least two persons that will occur when implementing the agreement, and ensure the sufficient number of employees due to that end. Such works should be identified on the basis of the task risk assessment (APR) and applicable regulations.
 

6. Machines, equipment and technical devices

 

6.1. The Contractor shall be obliged to ensure that all machines and technical devices used at the construction site meet requirements of regulations and EU directives, and are legibly marked with a CE sign.

When the CE sign is missing, machines and technical devices can be used subject to having a declaration of conformity with essential requirements of applicable European Union directives. The declaration can be in Polish or English language. When the declaration is in English language, the translation by a certified translator should be available. This in particular refers to: all types of construction machinery, handling equipment, pressure equipment and any equipment using which requires a licence issued by the Institute of Construction Machines and Rock Mining.

 

6.2. All vehicles, mobile machines and devices should be equipped with a warning/strobe lamp (indicating the movement of the vehicle) and audible reverse alarm.

 

6.3. In the case of delivery of scaffoldings with assembly or performance of works using scaffoldings, including assembly and disassembly works, it is necessary to ensure that the assembly is carried out by persons having the scaffolding assembly authorisation, and that the acceptance is in each case carried out by persons holding building authorisations and qualifications to supervise assembly works and to accept and confirm the correctness of the scaffolding assembly.

 

6.4. The Contractor shall be obliged to keep, at the place of work, the documentation providing a basis for the safe operation of devices, scaffoldings and machines, e.g.: scaffolding designs, acceptance reports, documents of inspections by the Office of Technical Inspection (UDT), etc.

 

7. Safety of electrical system operation

 

7.1. The Contractor shall be obliged to carry out works at the construction site using power tools ensuring at least the IP44 level of protection against external factors.


7.2. All electrical cables used at the construction site, including extension cords, should consist of sheathed cables (the cable marked with the letter “O”) and be approved for use at the open area.

7.3. All power equipment used at the construction site should comply with requirements of standards and be marked with a CE sign.

 

8. Work at heights

 

8.1. Work at heights should be arranged using professional platforms and working scaffoldings. It shall be forbidden to arrange work at height using ladders, as a standard.

 

Using ladders shall be permitted in the case of performing single activities, subject to including conditions for the performance thereof in the ISEW and obtaining the approval of the construction site manager.

 

8.2. When planning works at heights, first of all, it is necessary to plan the protection of work posts, using collective protection measures. If impossible, works can be performed using personal protective measures, subject to determining their type and use in the ISEW, and after obtaining the approval of the construction site manager.

 

9. First aid

 

The Contractor shall be obliged to provide employees, and in particular persons trained to provide first aid (in accordance with section 2.3), with a portable first aid kit containing basic materials and resources to provide first aid. The content of the first aid kit shall be determined by a physician specialising in occupational medicine cooperating with the Contractor. The content of the first aid kit shall be checked on the basis of the list of materials and resources approved by the physician. The first aid kit should be supplemented on an ongoing basis.

 

10. Fire protection

 

When carrying out works involving fire risk, the Contractor shall be obliged to provide, at workplaces, the equipment specified in the ISEW to prevent the spread of fire. Fire extinguishers should have a current certificate confirming technical inspection, as recommended by the manufacturer.
Always when carrying out works involving fire risk, the Contractor shall be obliged to obtain the permit for work from the General Contractor in accordance with the procedure (PTW).

 

11. Social base

 

The Contractor shall be obliged to ensure, for all persons employed for the purposes of the performance of work, the sanitary and social base, including:

 

  • changing room,
  • dining room,
  • toilets located close to work places,
  • sanitary facilities (washrooms, showers, toilets).

 

This duty shall be fulfilled in close cooperation with the General Contractor, who makes available the sanitary base to all persons working at the construction site. The manner of settlement of costs (costs of rental and use of containers and cost of cleaning) shall be set in the agreement.

 

12. Environmental protection, waste collection and segregation

 

12.1. At the stage of the cost assessment, the Contractor shall be obliged to take into account standard requirements of Budimex SA pertaining to environmental protection as well as legal and other requirements applicable in the area of the project (requirements of the environmental decision).


12.2. The Contractor shall be responsible for utilisation of waste generated by the Contractor. This means that the Contractor is obliged to properly collect waste (waste containers or other containers), to establish cooperation with a company collecting waste and to keep records of waste.


12.3. Before starting works, the Contractor shall be obliged to describe, in the Instruction of Safe Execution of Works (ISEW) the type and quantity of hazardous waste expected to be generated, and the method of utilisation of this waste, in accordance with the construction Waste Management Plan adopted as part of the SHP Plan, in accordance with the scope of works of the Contractor.

 

12.4. When the waste is collected by the General Contractor, the organisation method and financial settlements are a part of the agreement.

 

12.5. The Contractor shall be obliged to respond to emergency situations and environmental incidents in accordance with the system and standard of conduct adopted by the Budimex SA, and the Contractors carrying out works using construction machines and vehicles shall be obliged to make available to their employees:

 

  1. sorbent to trap leaks of fuel and technical liquids,
  2. absorption pads to prevent fuel drips while fuelling.

 

13. Documents and their storage

 

The Contractor shall be obliged to have, at the construction site, the documentation providing a basis for the authorization to carry out the works, including the documentation of the technology process preparation and the documentation pertaining to persons participating in the performance of works — “Contractor file binder.” The Contractor shall be obliged to present the aforementioned documents at every request of the General Contractor.

 

Obligatory documents to be included in the “Contractor file binder” include:

 

  • assessment of professional risk for the task (APR),
  • approved and accepted Instruction of Safe Execution of Works (ISEW),
  • current medical certificate confirming the lack of contraindications for work issued by a physician entered in the register of physicians performing preventive medical examinations, kept by the voivodeship occupational medicine centre (in the case of employees – foreigners from EU countries, translations of medical certificates by a certified translator are acceptable),
  • current certificate confirming regular training on occupational health and safety. In the case of blue-collar employees, the training shall be updated at least once a year, while in the case of employers and persons managing employees, the update shall be required at least every 3 years,
  • certificates confirming on-the-job training,
  • technical and operating documentation of machines and equipment, operating instructions, safety data sheets of chemicals, designs, measurements, documents confirming safety at the work place, etc.,
  • documents confirming checks performed, as required by the manufacturer of personal protective equipment,
  • daily briefing cards (start card),
  • other, set in the SHP Plan or required by the Construction Site Manager.

 

 

Any doubts and the method of fulfilment of the aforementioned duties will be discussed during the negotiation meeting. Please prepare the information in the aforementioned respect.
