Signature of a contract for Construction of the Southern Section of Żelazny Most Waste Treatment Facility - Stage I (Phase 1,2,3).

The Management Board of Budimex SA announces that on 8 May 2018 Budimex SA concluded a contract with KGHM Polska Miedź SA for Construction of the Southern Section of Żelazny Most Waste Treatment Facility - Stage I (Phase 1,2,3). The company informed that Budimex’s bid had been selected as the most advantageous one in current report No 19/2018 of 11 April 2018.

Contract value: PLN 578,000,000 net

Works commencement date: 21.05.2018

Works completion date: 31.12.2021

Guarantee period: 60 months

Statutory warranty period: 60 months

Advance payment: none

Payment terms: 60 days from the date of a correctly issued invoice by the Contractor

Performance bond: 5% of gross remuneration

Contractual penalties: the total value of contractual penalties due for the Ordering Party shall not exceed 20% of the Accepted Contract Amount

Bond for the guaranty and statutory warranty period: 30% of the performance bond amount

The Ordering Party reserves the right to demand supplemental damages in excess of contractual penalties up to the amount of the actual loss that was incurred. The Parties reserve the right to claim damages in excess of the stipulated contractual penalties, or damages arising from events for which no contractual penalties have been stipulated, on general terms.

The value of the contract exceeds the threshold of PLN 127,386 thousand net.
