Selection of Budimex SA’s bid by KGHM Polska Miedź SA

The Management Board of Budimex SA announces that on 11 April, KGHM Polska Miedź SA selected the bid of Budimex SA as the most advantageous one in the tender for Construction of the Southern Section of Żelazny Most Waste Treatment Facility - Stage I (Phase 1,2,3).

Bid value: PLN 578,000,000 net

Works commencement date: counted from the date of the Ordering Party’s obtaining of a construction permit

Works completion date: 31 December 2021

Guarantee period: 60 months

Statutory warranty period: 60 months

Advance payment: none

Payment terms: 60 days from the date of a correctly issued invoice by the Contractor

Performance bond: 5% of gross remuneration

Contractual penalties: the total value of contractual penalties due for the Ordering Party shall not exceed 10% of the Accepted Gross Contract Amount

Bond for the guaranty and statutory warranty period – 30% of the performance bond amount

The Ordering Party reserves the right to demand supplemental damages in excess of contractual penalties up to the amount of the actual loss that was incurred. The Parties reserve the right to claim damages in excess of the stipulated contractual penalties, or damages arising from events for which no contractual penalties have been stipulated, on general terms.

The bid value exceeds the threshold of PLN 127,386 thousand net.
