Signing an annex to the agreement with Dom Development S.A. for construction, as a general contractor, of the I stage of the housing project “Marina Mokotów II”

The Management Board of Budimex S.A. announces that on 21 February 2018 it has signed an annex to the agreement of 27 June 2017, concluded with Dom Development S.A. for construction, as a general contractor, of the I stage of the housing project “Marina Mokotów II” in the Mokotów district in Warsaw.

Under the said annex, the remuneration for completion of the aforementioned agreement was established as PLN 112,200,351.89 net.

The amount of remuneration in the agreement of 27 June 2017 was set below the threshold for considering the said agreement as a significant agreement, which as of 27 June 2017 amounted to PLN 111,446 thousand.

Works commencement date: 2 May 2018

Final acceptance date: 10 December 2019

Guarantee period: 72 months starting from the Work Acceptance Date.

Advance payment: none

Good performance bond: bank guarantee for 5% of the net contract value and part two, deposit amounting to 5% of the net value of each invoice.

The total amount of contractual penalties shall not exceed 12% of the remuneration for performance of the subject matter of the agreement.

The Investor has a right to claim damages in excess of the reserved amount of contractual penalties.

The provisions of the agreement do not vary from the ones applied commonly in agreements of this type.

The bid value exceeds the threshold of PLN 111,446 thousand.
