Signing of an Annexe to the Bank Guarantee Line Contract with Bank Millennium SA

The Management Board of Budimex S.A. (“Company”) reports that on 20 May 2010 it received from Bank Millennium SA (“Bank”) a signed Annexe to the Bank Guarantee Line Contract dated 31 July 2009. The Company reported on this Contract in Current Report no. 62/2009 of 4 August 2009 (“Agreement”).
Pursuant to the Annexe:

• (1) the guarantee limit to which the Company may order the Bank to issue bank guarantees has increased from PLN 195,000,000 to PLN 260,000,000.
• (2) the deadline when the Company may order the Bank to issue bank guarantees has been prolonged until 17 May 2011.
  Repayment of the Company’s receivables towards the Bank on account of the Contract has been secured with:
  • - the Company statement on submission to execution;
  • - a power of attorney to administer the Company’s bank account maintained by the Bank.
• Other provisions of the Contract remain unchanged.

The Contract value exceeds 10% of the equity of Budimex SA.
