Agreement on bank guarantees with Banco Popular Espanol S.A.

The Management Board of Budimex SA announces that on 18 April 2016 Budimex signed an agreement on bank guarantees with Banco Popular Espanol S.A.

Under the agreement, Budimex can order the Bank to issue bank guarantees of up to PLN 100,000,000 (say: one hundred million zlotys).

The agreement was concluded for the period until 31 March 2017.

To secure its obligations under the agreement, Budimex will submit to the Bank a declaration on submission to enforcement pursuant to Article 777(1)(5) of the Civil Proceedings Code.

The remaining terms and conditions of the agreement do not vary from the ones applied commonly in agreements of this type.

The value of the agreement exceeds 10% of the equity of Budimex SA.
