“Management of municipal waste from the Capital City of Warsaw in the planned maximum quantity of 104,000 Mg” — selection of bids of the consortium of FBSerwis Group companies

The Management Board of Budimex SA hereby announces that it has been informed that Miejskie Przedsiębiorstwo Oczyszczania w m. st. Warszawie Sp. z o.o. [Municipal Cleaning Company in the Capital City of Warsaw] has selected the following bids of the consortium: FBSerwis Kamieńsk Sp. z o.o. (a company owned in 80% by Budimex S.A.) and FBSerwis Karpatia Sp. z o.o., FBSerwis Dolny Śląsk Sp. z o.o., FBSerwis Wrocław Sp. z o.o. (companies wholly owned by Budimex S.A.), as the most advantageous in the tender procedure for the management of municipal waste from the Capital City of Warsaw in the planned maximum quantity of 104,000 Mg; (a) Task 1 (4.1)* — management of municipal waste from the Capital City of Warsaw in the planned maximum quantity of 10,000 Mg, (b) Task 2 (4.2)* — management of municipal waste from the Capital City of Warsaw in the planned maximum quantity of 58,000 Mg, (c) Task 3 (7)* — management of municipal waste from the Capital City of Warsaw in the planned maximum quantity of 36,000 Mg.

Bid value: PLN 64,376,000 net

The above-mentioned bids have resulted in the total value of orders with the same Ordering Party in the last 12 months amounting to PLN 185,001,400 net.

The terms under which the bid has been submitted:

Bid value: PLN 64,376,000 net

Date of commencement of the service provision: from 01.10.2021, in accordance with the terms and conditions set forth in the ToR; the estimated date of commencement of the service provision may change depending on the date of conclusion of the agreement.

Service completion date: up to 12 months from the commencement of the agreement implementation.

Payment terms: 30 days from the day of delivery of a correctly issued VAT invoice to the Ordering Party by the Contractor

Remuneration payable for monthly periods, based on the quantity of waste received for processing.

Performance bond: 3% of gross order value

The bid includes the development of a maximum of 104,000 tonnes of municipal waste from (residential property) in Warsaw. The waste stream includes all fractions, including selective ones (paper, glass, etc.).

Maximum amount of contractual penalty payable by the Ordering Party: 10% of gross order value

The Ordering Party reserves the right to seek damages under general applicable rules if the amount of loss sustained exceeds the amount of the stipulated penalty.

Other terms and conditions of the contract do not differ from the market standards.

The total value of contracts signed between Budimex and its subsidiaries and Miejskie Przedsiębiorstwo Oczyszczania w m. st. Warszawie Sp z o.o. together with the value of bids exceeds the threshold of PLN 167,645 thousand net.
