Design and construction of the ring road of Augustów as part of national road no. 8 and express road S-61 – information obtained on the selection of offer by Budimex SA

The Management Board of Budimex S.A. announces that on 9th February 2011 it received information from the General Directorate for National Roads and Motorways - Białystok Branch concerning the selection of the offer of Budimeks SA as the most favourable in the proceedings of the public procurement procedure carried out by a limited tender procedure known as: “Design and construction of the ring road of Augustów as part of national road no. 8 ( section from Augustów junction to Szkocja junction) and express road S-61 (section from Szkocja junction to Lotnisko junction)”.

• Contract value: PLN 535 998 924,98 net
• Commencement date: the date of concluding the contract
• Completion date: 42 months from the date of concluding the contract
• Guarantee period: 5 years
• Financial conditions:
• Payment: within 30 business days from receiving the invoice by the Contracting Authority
• Bank guarantee of successful execution: 5% of the gross contractual amount
• Contractual penalties paid by the Contractor:
  - for exceeding the deadline for completion of the conceptual design and obtaining the maps for the purposes of the design and obtaining the recognition of applicable certificates – 0,02% of the contractual gross amount per each day of delay
  - for exceeding the deadline for completion of the construction and implementation design – 0,02% of the contractual gross amount per each day of delay
  - for exceeding the deadline for completion of works – 0,05% of the contractual gross amount per each day of delay
  - for exceeding the deadline to remove defects specified in the Take-over certificate – 0,01% of the contractual gross amount per each day of delay
  - for exceeding the deadline for the submission of the schedule – 0,002% of the contractual gross amount per each day of delay
  - for withdrawal from the contract due to reasons attributable to the Contractor – 10% of the contractual gross amount
• Penalties paid by the Contracting Authority:
  - for withdrawal from the contract due to reasons attributable to the Contracting Authority – 10% of the contractual gross amount
• The Contracting Authority reserves the right to supplementary compensation in excess of the amount of the contractual penalties to the amount of damage actually suffered.
• The value of the contract exceeds 10% of the equity of Budimex S.A.
