A list of shareholders present at the Budimex S.A. OGM holding over 5% of the votes at the OGM.

The Management Board of Budimex S.A. releases to the public a list of shareholders having at least 5% of the votes at the Budimex S.A. OGM, which took place on the 19 May 2010, together with details of the number of votes each is eligible to as a result of the number shares owned and indicating their percentage share in the number of votes at this General Meeting and in the overall number of votes:

• 1. VALIVALA HOLDINGS B.V. – number of votes: 15,078,159; percentage share in the number of votes at the OGM: 83.79%; percentage share in the overall number of votes: 59.06%.
• 2. OFE PZU “Złota Jesień” - number of votes: 1,300,000; percentage share in the number of votes at the OGM: 7.22%; percentage share in the overall number of votes: 5.09%.
• 3. AVIVA Otwarty Fundusz Emerytalny AVIVA BZ WBK – number of votes: 1,000,000; percentage share in the number of votes at the OGM: 5.55%; percentage share in the overall number of votes: 3.92%.
