Delivery of concrete mixtures - a contract with the supplier of Budimex SA

The Management Board of Budimex SA would like to inform you that on 10 May 2016 the company concluded the subsequent contract on the delivery of concrete mixtures with Cemex Polska sp. z o.o., with its registered office in Warsaw. The total value of contracts signed within the last 12 months is: PLN 83,080,466.59 net.
 
Date of signing the contract of the highest value: 10 May 2016.
Contract value: PLN 28,931,020.53 net.
Start date of supplies: January 2017
End date of supplies: 31 December 2018
Guarantee period: 121 months
Financial terms and conditions:
Advance payment: no
Payment: 30 days from the delivery of the invoice to the Ordering Party.
Bank performance bond: 10% of gross remuneration.
 
Contractual penalties paid by the supplier:
10% of gross remuneration for the delivered consignments of goods for each day of delay
1% of gross remuneration for the delivered consignments of goods for delay in removal of defects found upon receipt within the guarantee and warranty period for each day of delay.
10% of gross remuneration for the withdrawal from the contract or its termination due to reasons attributable to the supplier.
 
Contractual penalties paid by the Ordering party:
10% of gross remuneration for the withdrawal from the contract due to reasons attributable to the Ordering party.
 
The Ordering Party reserves the right to seek damages on general principles if the amount of loss sustained exceeds the amount of the stipulated penalty.
 
The value of contracts signed with the supplier within the last 12 months exceeds 10% of the equity capital of Budimex SA.
