Continuation of the design and construction of the S-5 express road section Nowe Marzy – Bydgoszcz – border of Kujawsko-Pomorskie and Wielkopolskie provinces. Part 1 – Budimex S.A. bid rated highest

The Management Board of Budimex S.A. announces that on 9.01.2020, the General Directorate for National Roads and Motorways Branch in Bydgoszcz notified the Company that its bid was rated highest in the tender procedure for: the “Continuation of the design and construction of the S-5 express road section Nowe Marzy – Bydgoszcz – border of Kujawsko-Pomorskie and Wielkopolskie provinces, divided into 2 parts: Part 1 – Continuation of the design and construction of the S-5 express road section from the Nowe Marzy junction (without the junction) to the Dworzysko junction (incl. the junction) of approx. 23.3 km”.

The aforementioned information does not mean selecting the bid of Budimex S.A. as the most advantageous one because the procedure concerning the bid evaluation has not yet been finally completed.

Bid value: PLN 460,801,720 net

Works commencement date: not later than 7 days from the Contract date

Works completion date: 20 months from the Contract date

Guarantee period for main works: from 5 to 10 years

Warranty period: 5 years

Advance payment: maximum 10% of the Accepted Gross Contract Amount

Payment terms: 30 days from the day of delivery of a correct VAT invoice to the Ordering Party by the Contractor

Bank performance bond: 10% of the Accepted Gross Contract Amount

Maximum amount of contractual penalty paid by the Contractor: 20% of the Accepted Gross Contract Amount

The Employer shall pay the Contractor a contractual penalty for the Contractor’s withdrawal from the contract due to causes attributable to the Employer amounting to 15% of the Accepted Gross Contract Amount.

The Employer reserves the right to demand supplemental damages in excess of contractual penalties to the amount of the actual loss that was incurred or could be incurred due to the improper performance of the Contract by the Contractor.

Other terms and conditions of the contract do not differ from the market standards.

The bid value exceeds the threshold of PLN 147,743 thousand net.
