The construction of the S8 Expressway S8 between the Walichnowy Junction and the Wrocław Junction (A1), Section 8 (Róża – Wrocław): from 183+350.00 KP to 202+700.00 KP – notice about the selection of the Budimex SA bid.

The Budimex SA Board hereby informs you that on 01 August 2011 it received from the Łódź Branch of the General Directorate of Roads and Motorways the notice about the selection of the Budimex SA bid as the most favourable in the procedure for granting the public procurement by way of a limited tender to carry out construction works as part of the project: “The Construction of the S8 Expressway on the Walichnowy Junction – Wrocław Junction (A1), Section 8 (Róża – Wrocław): from 183+350.00 KP to 202+700.00 KP”.

• Contract net value: 689 243 963.78PLN.
• Date of commencement: no later than 14 days from the date of entering into the contract.
• Date of completion: 27 months from the date of entering into the contract, including winter periods.
• Warranty period: 60 months from the date indicated in the takeover certificate.
• Surety period: 12 months from the date indicated in the takeover certificate; removal of power interference - 36 months from the date of final commissioning of the power line.
• Financial terms and conditions:
  • Payment must be made 30 days from the date of delivery of the invoice to the Ordering Party.
  • Good workmanship bank guarantee: 5% of the contract gross amount.
• Penalties payable by the Contractor:
  • 0.02% of the accepted contract amount for each day of default for exceeding the time limit for work completion.
  • 10% of the accepted contract amount for withdrawal from the contract due to reasons attributable to the Contractor.
  • 0.02% of the accepted contract amount for each day of default for failure to perform the required minimum within: a) 10 months from the date of entering into the contract, no less than 20% of the accepted contract amount; b) 15 months from the date of entering into the contract, no less than 40% of the accepted contract amount.
  • 30 000.00PLN for each subcontractor that was not declared, for failure to report any of the subcontractors.
• Penalties payable by the Ordering Party:
  • For withdrawal from the contract due to reasons attributable to the Ordering Party - 10% of the accepted contract gross amount.

The Ordering Party is entitled to claim supplementary compensation where it exceeds the amount of liquidated damages to the amount of the factually sustained damage.
The contract value exceeds 10% of the Budimex SA own assets.
