New contract for Budimex S.A. – PKP railway station

The Management Board of Budimex S.A. announces that the consortium of companies Budimex S.A. (leader) and Ferrovial Agroman S.A. (partner) signed with Polskie Koleje Państwowe S.A. with its registered office in Warsaw a contract on “Reconstruction of the historic Wrocław Główny railway station complex together with rebuilding of railway technical infrastructure” on March 2, 2010.

• Contract value: PLN 265,686,499.47 net
• Commencement date: 02.03.2010
• Completion of work and obtaining occupancy permit deadline: 114 weeks
• Guarantee period: 3 years form completion of work and obtaining occupancy permit date
• Financial conditions:
  • Payment: 60 days after the Contracting Authority has received the Payment Certificate along with the VAT invoice correctly issued by the Contractor.
  • Bank guarantee for successful execution: 10 % of the gross offered price.
    70 % of the security value will be repaid 30 days after the date of the Taking-Over Certificate and acceptance of the order as duly completed by the Contracting Authority.
    30% of the security value will be repaid 15 days from the date of Execution Certificate the latest.
  • Maximum penalties for a delay paid by the Contractor: 20% of the approved contractual amount (including VAT).
  • The Contracting Authority reserves the right to supplementary compensation in excess of the amount of contractual penalties to the amount of damage actually suffered.

The contract value exceeds 10% of the equity of Budimex S.A.
