Information about the selection of the offer by Budimex SA – Extension of the Karczemki junction in Gdańsk

The Management Board of Budimex S.A. hereby reports that on 19th February 2010 it received from the Gdańsk-based division of the General Directorate for National Roads and Motorways information about the selection of the offer by Budimex SA as the most favourable offer in the proceedings concerning the public procurement procedure carried out by an unlimited tender procedure for construction works: “Extension of the junction of the Tri-City Ring Road (National Road S6) with Kartuska Street (National Road 7) – the Karczemki junction in Gdańsk.”

• Contract value: PLN 152,926,000 net
• Commencement date: the date of concluding the contract
• Deadline: 15. 05. 2012
• Guarantee period: 60 months after the works have been completed
• Financial conditions:
  • Payment: 49 days after the Contracting Authority has received the Payment Certificate along with the correctly issued VAT invoice of the Contractor
  • Bank guarantee for successful execution: 5% of the gross offered price
  • Contractual penalties paid by the Contractor:
    • A. For exceeding the Deadline for the Completion of Works for reasons involving the Contractor – 0.04% of the Approved Contractual Amount per each day
    • B. For failure to perform the Required Minimum Performance – 0.04% of the Approved Contractual Amount per each day
    • C. For withdrawal from the Contract for reasons involving the Contractor – 10% of the Approved Contractual Amount
    • D. For exceeding the deadline for submitting the schedule, the report, the draft contract with the subcontractor and the deadline for submitting price calculation – PLN 5,000.00 per each day
    • E. For exceeding the deadline to remove defects and to perform minor overdue works specified in the Take-over Certificate or later, within the period of warranty for failures by the date specified by the Engineer – PLN 5,000.00 per each day
  • Contractual penalties paid by the Contracting Authority:
    • A. For withdrawal from the Contract – 10% of the Approved Contractual Amount
  • The Parties reserve the right to supplementary compensation in excess of contractual penalties up to the amount of damage actually suffered.

The contract value exceeds 10% of the equity of Budimex S.A.
