Construction of Wałbrzych ring road – signature of a contract

The Management Board of Budimex S.A. announces that on 4 April 2019 a contract has been concluded between Wałbrzych municipality – Roads, Transport and Town Services Administration in Wałbrzych and the General Directorate for National Roads and Motorways, Wrocław Branch and Budimex S.A. for the “Construction of Wałbrzych ring road along the national road No 35”.

The information that our bid in the tender proceedings was selected as the most advantageous one was published the current report No 6/2019 of 25 January 2019. Company announced that the Employer rated highest the bid in this tender in the current report No 77/2018 of 31 December 2018.

Bid value: PLN 249,637,589.90 net.

Works commencement date: upon submitting the accepted Temporary Traffic Organisation Plan

Works completion date: 20 months from the Contract date.

Guarantee period: 60 months

Advance payment: from 5% to 10% of the accepted gross contract amount.

Payment terms: 30 days from the day of delivery of a correct VAT invoice to the Ordering Party by the Contractor

Bank performance bond: 10% of the Accepted Gross Contract Amount.

Penalties paid by the Contractor: The total value of contractual penalties due for the Ordering Party shall not exceed 20% of the Accepted Gross Contract Amount

Penalties to be paid by the Ordering Party: 15% of the Accepted Gross Contract Amount for withdrawal from the contract due to reasons attributable to the Ordering Party

The ordering party reserves the right to demand supplemental damages in excess of contractual penalties up to the amount of the actual loss that was incurred. The penalties are independent from one another and the Ordering Party has the right to seek payment of each of them separately.

Other terms and conditions of the contract do not differ from the market standards.

The value of the contract exceeds the threshold of PLN 147,743 thousand net.
