The development of a hall complex for KGHM Polska Miedź SA - information on the selection of the tender submitted by Mostostal Kraków SA

The Management Board of Budimex S.A. communicates that it was notified by Mostostal Kraków S.A. (100% subsidiary of Budimex S.A.) on the selection of the tender of Mostostal S.A. on 20 December 2012 by KGHM Polska Miedź S.A. with its registered office in Lubin in the tendering procedure for "The development of a complex containing a suspension roaster, electric furnace, heat recovery steam generator, electrical and energetic building, development of a hall to contain anode furnaces together with the supporting construction and installations".

• Contract value: PLN 118,000,000 net
• Commencement date: the date of execution of the contract
• Deadline: 16 May 2014
• Guarantee period: 120 months
• Financial terms and conditions:
  • Advance payment: 8.47% of the net contract value
  • Terms of payment: 30 days from the delivery of the invoice to the Contracting Authority
  • Performance bond: 10% of the net contract value
• Maximum liquidated damages to be paid by the Contractor: 10% of the net contract value
• The Contracting Authority may seek damages in excess of the amount of stipulated liquidated damages

The contract value exceeds 10% of the equity of Budimex SA.
