Construction of ferry quay no. 1 at Świnoujście port – a new Budimex SA contract

The Management Board of Budimex SA reports that on 29 November 2012 the consortium of Budimex SA (leader) and Ferrovial Agroman SA (partner) concluded a contract with Zarząd Morskich Portów Szczecin i Świnoujście SA for the "Port infrastructure expansion in the southern part of Świnoujście port. Construction of ferry quay no. 1."

• Net contract value: PLN 68,525,874.86
• Commencement date: 21 days from the date of concluding the contract
• Deadline: 30 November 2014
• Guarantee period: 36 months
• Financial terms and conditions:
  • Payment: 30 days from the date of delivering the invoice to the Contracting Authority
  • Performance bond – 10% of the approved gross contractual amount
• Penalties payable by the Contractor:
  • 10% of the approved gross contractual amount for withdrawing from the contract for reasons attributable to the Contractor
  • 0.03% of the approved gross contractual amount for each day of exceeding the deadline for the completion of works
  • PLN 10,000 for each day of exceeding the deadline for the removal of defects and the performance of minor overdue works specified in the final works acceptance protocol
  • PLN 5,000 for each day of exceeding the deadline for the removal of defects or damage – in the period for reporting defects: within the deadline specified by the Engineer, and in the remaining quality guarantee period: within the deadline specified by the Contracting Authority
• Penalties payable by the Contracting Authority:
  • 10% of the approved gross contractual amount for withdrawal from the contract for reasons attributable to the Contracting Authority
• The Parties reserve the right to supplementary compensation which adapts the amount of contractual penalties to the amount of damage actually suffered

The value of the contract exceeds 10% of the equity of Budimex SA.
