Comprehensive maintenance of the A1 motorway section between Sośnica junction and the state border – a new contract for Budimex Budownictwo Sp. z o.o.

The Management Board of Budimex SA announces that on 5 October 2012 a consortium consisting of Budimex Budownictwo Sp. z o.o. (leader, a 100% subsidiary of Budimex SA) and Ferrovial Servicios SA (partner), and the General Directorate of National Roads and Motorways, Katowice Branch, entered into an agreement for the maintenance of the A1 motorway section between Sośnica junction (excluding the junction itself) and the state border with the Czech Republic in Gorzyczki, totalling 47.849 km, under the "maintain the standard" system.

• The contract is worth PLN 41,919,156.72 net.
• Contract performance involves various scopes of works, as specified by the Contracting Authority: a) comprehensive (summer and winter) maintenance of the A1 motorway section between Świerklany and Gorzyczki under the "maintain the standard" system, and b) comprehensive (summer and winter) maintenance of the A1 motorway section between Sośnica junction (without the junction itself) and Świerklany under the "maintain the standard" system. It shall commence as ordered by the Contracting Authority, but not later than within 2 days from the order in this respect being issued to the Contractor. The Contractor shall be in full readiness to commence carrying out the works.
• The contract shall terminate 72 months after the commencement of its performance.
• Financial terms and conditions:
  • Payment: 30 days from the date of delivering the invoice to the Contracting Authority.
  • Bank guarantee of good performance: 5% of the gross contract value
• Penalties paid by the Contractor:
  • For contract termination by the Contracting Authority for reasons related to the Contractor: PLN 200,000,
  • For cases of works constituting the object of the contract being carried out by an entity other than the Contractor or a subcontractor assigned for such works in accordance with the procedure specified in the contract: PLN 50,000 for each case of such breach of the contract,
  • For breaching the Contractor's duties specified in the contract: PLN 10,000 for each breach and additionally PLN 10,000 for each day of continuation of such breach.
• Penalties paid by the Contracting Authority:
  • For contract termination by the Contracting Authority due to the gross fault of the Contracting Authority: PLN 200,000, except for the case specified in Article 145 of the Public Procurement Act.
• The Contracting Authority reserves the right to claim supplementary compensation exceeding the amount of the stipulated liquidated damages and reflecting the full amount of damage actually suffered.

The contract value exceeds 10% of the equity of Budimex S.A.
