Construction of a border crossing in Dołhobyczów – information on the selection of the offer by a consortium including Budimex SA

The Management Board of Budimex S.A. reports that on 10 September 2012 it was informed that on 7 September 2012 the company received a letter announcing the selection of the offer submitted by a consortium including Budimex S.A. (leader) and T4B from Lubelski Zarząd Obsługi Przejść Granicznych (the Lublin Executive Board for Border Crossings) based in Chełm, in public procurement proceedings conducted by open tender for the construction of a border crossing in Dołhobyczów - stage I, part IV.

• Value of the offer: PLN 34,439,862.79 net
• Commencement date: once the construction site has been handed over
• Deadline: 30 November 2013
• Guarantee period: 36 months
• Financial terms and conditions:
  • Payment: 30 days from the date of delivering the invoice to the Contracting Authority.
• Penalties paid by the Contractor:
  • 0.1% of gross remuneration for each day of delay in carrying out construction works
  • 0.1% of remuneration for each day of delay in commencement of construction works in excess of 14 days from the date of handing over of the construction
  • 0.1% of remuneration for each day of delay in removing defects discovered during the acceptance procedure or during the guarantee and warranty periods
  • 10% of gross remuneration for withdrawing from the contract due to reasons attributable to the contractor
• The Parties have the right to claim compensation pursuant to general terms if the value of the damage exceeds the stipulated penalty

The value of the offer exceeds 10% of the equity of Budimex SA.
