A new contract for Budimex SA - Reconstruction of a tramway line in Krakow

The Management Board of Budimex SA reports that on 3 September 2012 the Company signed a contract with Zarząd Infrastruktury Komunalnej i Transportu w Krakowie (the Municipal Infrastructure and Transport Authority in Krakow) for the reconstruction of the tramway line section from Rondo Mogilskie through Aleja Jana Pawła II to Plac Centralny with the traffic control system in Krakow.

• The contract is worth PLN 113,367,020.47 net
• Commencement date: 14 days from the day of concluding the contract
• Deadline: 24 months form the date of concluding the contract
• Guarantee period: 120 months for road construction work, engineering structures, power networks, sanitary sewage systems and telecommunication engineering networks; 36 months for all other works
• Financial terms and conditions:
  • Payment: 30 days from the date of delivering the invoice to the Contracting Authority
  • Bank performance guarantee: 7% of the contract gross price
• Penalties paid by the Contractor:
  • Maximum amount of penalty for delays: 30% of the approved gross contractual amount
• Irrespective of reserved contractual penalties, the Contracting Authority is entitled to claim damages, on the grounds of general rules, to the amount of damage actually suffered

The contract value exceeds 10% of the equity of Budimex SA.
