Design and construction of an incineration plant in Białystok - information about the selection of the offer submited by a consortium including Budimex SA

The Management Board of Budimex SA reports that on 26 June 2012 it received a letter from Przedsiębiorstwo Usługowo-Handlowo-Produkcyjne "LECH" of Białystok informing of the selection of the offer by the consortium of Budimex S.A. (leader, 50.4%), Keppel Seghers Belgium N.V and Cespa Compania Espanola de Servicios Publicos Auxiliares S.A. under the proceedings for public procurement with respect to the design and construction of a Municipal Waste Neutralisation Plant in Białystok.

• Value of the offer: PLN 332,958,245.00 net.
• Commencement date: immediately upon concluding the contract.
• Deadline: 31 December 2015.
• Guarantee period: 24 months counting from 31 December 2015 for the entirety of the works (except for quick-wear parts and devices), with the reservation that the guarantee period for the durability and lifetime of the grate is 48 months counting from 31 December 2015 and the guarantee period for the durability of the bag filter sleeve and the final level heater is 36 months counting from 31 December 2015.
• Financial terms and conditions:
  • Payment: 30 days from the date of delivering the invoice to the Contracting Authority.
  • Good performance bank guarantee: 10% of the gross contract value
• Penalties paid by the Contractor:
  • Maximum liquidated damages for delay: 20% of the gross contract value.
  • Maximum liquidated damages for failing to ensure guarantee parameters: 10% of the gross contract value.
• The Contracting Authority reserves the right to claim supplementary compensation exceeding the amount of liquidated damages and reflecting the amount of damage actually suffered.
