Protection of sea coasts east of Port Darłowo - information on the selection of the offer by the consortium of Budimex SA and Ferrovial Agroman SA

The Management Board of Budimex SA reports that on 17 January 2012, the Maritime Office in Słupsk announced that during the proceedings for public procurement, in an open tender for the task entitled 'Protection of sea coasts east of Port Darłowo' (pursuant to Article 91 of the Public Procurement Act), the offer made by the consortium of Budimex SA (leader) and Ferrovial Agroman SA (partner) has been chosen as the most favourable one.

• Value of the Offer: PLN 75,832,369.85 net
• Commencement Date: Not later than 3 days after handing over the construction site
• Deadline: 31 May 2013
• Guarantee Period: 60 months
• Warranty Period: 12 months after the expiry of the guarantee period
• Financial Terms and Conditions:
  • Payment: 21 days from the date of delivering the invoice to the Contracting Authority
  • Bank Performance Guarantee: 10% of the gross asking price
• Penalties Paid by the Contractor:
  • 0.05% of the net contractual price for each full calendar day exceeding the deadline set for the subject matter, for the delay in handing over the subject matter to the Contracting Authority;
  • 0.01% of the net contractual price for each full calendar day exceeding the date of acceptance of the subject matter, for the delay in handing over a partial execution of the subject matter to the Contracting Authority;
  • 0.02% of the net contractual price for each full calendar day of delay (calculated from the date agreed for the removal of defects until their removal), for the delay in removal of defects in the subject matter detected on delivery or during the guarantee period specified in the contract;
  • 10% of the net contractual price in case of termination or withdrawal from the contract for reasons attributable to the Contractor.
• The Parties reserve the right to supplementary compensation, which carries the value of contractual penalties equal to the amount of damage actually suffered

The value of the offer exceeds 10% of the equity of Budimex SA.
