Construction of buildings G, H and an upward extension of building F, under the project of "outward extension and alteration of the Teaching Hospital of the Medical University in Białystok" - information about selection of the bid by consortium Budimex SA

The Management Board of Budimex SA reports that on 8 April 2011 it received a notification form the Medical University in Białystok on the selection of bid by the consortium Budimex SA (leader) and Ferrovial SA as the most favourable bid in the proceedings concerning the public procurement procedure carried out by a limited tender procedure for the outward extension and alteration together with internal installations and non-medical equipment of the buildings G and H as well as an upward extension of the building F, of the Teaching Hospital of the Medical University in Białystok.

• Net value of the bid: PLN 119,700,000.00
• Commencement date: 14 days from the day of concluding the Contract. Conclusion of the agreement, subject to the Article 183 of the Public Procurement Law, within not less than 10 days from sending (by fax) a notification on the selection of the Contractor.
• Deadline: 33 months form the date of concluding the contract.
• Guarantee period: 36 month for works and supplies covered by the subject of the contract and 120 months for weathertightness of the roofing and ceiling materials.
• Financial terms and conditions:
  • Payment 30 days after the Contracting Authority has received an invoice.
  • Bank guarantee of successful execution – 10% of the gross contract value
• Penalties paid by the Contractor:
  • For withdrawing from the Contract by any party due to the reasons for which the Contractor is responsible - in the amount of 10% of gross contractual salary for section / sections to which the withdrawal applies to.
  • For delay in executing the subject of receipt specified in the Contract and its attachments, of more than 7 days - in the amount of 0.2% of the contractual gross remuneration (collectible for a given section in accordance with the material and financial schedule of works and supplies), for each day of delay, counting from the first day of delay.
  • For delay of more than 3 days in remedying defects found in the course of the receipt, or defects found subject to warranty and guarantee - in the amount of 0.2% of the contractual gross remuneration (collectible for a given section in accordance with the material and financial schedule of works and supplies) for each day of delay counting from the day set for remedying defects or faults.
  • For each day of delay in transferring the Contracting Authority the "Plan of safety and health protection" - in the amount of PLN 1,000, for identifying the presence of subcontractors on a construction site not reported to approval of the Contracting Authority or those who were refused an approval of the Contracting Authority - in the amount of PLN 10,000
• Penalties paid by the Contracting Authority:
  • The Contracting Authority shall pay the Contractor a contractual penalty for withdrawing from the Contract by the Contractor, due to the reasons for which the Contracting Authority is responsible, in the amount of 10% of the contractual gross remuneration for the task to which the withdrawal applies to. An occurrence of circumstances causing that the execution of the present contract is not in the public interest, which could not be foreseen at the time of conclusion of the contract, constitutes an exception to the above.
• The Contracting Authority is entitled to claim supplementary compensation which adapts the amount of contractual penalties to the amount of damage actually suffered.

The contract value exceeds 10% of the equity of Budimex SA.
