Construction of a bridge over the Vistula River near Kwidzyn together with driveways along national road no. 90 – a new contract for Budimex SA

The Management Board of Budimex S.A. announces that on the 3rd September 2010 the consortium of Budimex S.A. (the leader) and Ferrovial Agroman S.A. concluded a contract with the Gdańsk-based division of the General Directorate for National Roads and Motorways on the "Construction of a bridge over the Vistula River near Kwidzyn together with driveways along national road no. 90".

• Contract value: PLN 250,818,286.15 net
• Commencement date: no later than 30 days after concluding the contract
• Deadline: 27 months
• Guarantee period: 60 months
• Financial conditions:
  • Advance payment: the Contracting Authority allows for the possibility of advance payment in an amount not exceeding 10% of the Contractor's remuneration
  • Payment – in 28 days after the Contracting Authority has received a VAT invoice
  • Bank guarantee of successful execution – 5% of the approved contractual amount
• Contractual penalties paid by the Contractor:
  • For exceeding the deadline for the completion of works in the amount of 0.025% of the approved contractual amount per each day of delay;
  • For exceeding the deadline for the completion of works both in Stage I and Stage II of 0.025% of the approved contractual amount per each day of delay;
  • For withdrawal from the Contract for reasons involving the Contractor – 20% of the approved contractual amount;
  • For failure to perform the required minimum performance on time - 0.025% of the approved contractual amount per each day of delay;
• Penalties paid by the Contracting Authority:
  • The Contracting Authority will pay a contractual penalty of 10% of the approved contractual amount to the Contractor for withdrawal from the contract for reasons attributable to the Contractor. The penalty is not binding if withdrawing from the contract is for the reasons stipulated in Sub-clause 15.1 FIDIS and in Article 145 of the Public Procurement Act.
  • The Parties reserve the right to supplementary compensation which carries the amount of contractual penalties to the amount of damage actually suffered.

The contract value exceeds 10% of the equity of Budimex SA.
