Information about the selection of the offer by Budimex S.A. – Construction of the S-3 express road

The Management Board of Budimex S.A. hereby reports that on 13th May 2010 it received from the Zielona Góra-based division of the General Directorate for National Roads and Motorways information about the selection of the offer by the consortium of Budimex S.A. (leader) and Ferrovial Agroman S.A. as the most favourable offer in the proceedings concerning the public procurement procedure carried out by a limited tender procedure known as: "Construction of the S-3 express road in the section from the "Międzyrzecz Południe" junction to the "Sulechów" junction. 3 and 4 section from km 24+500 to km 42+954".

• Contract value: PLN 275,493,042.86 net
• Commencement date: no later than 30 days from the date of concluding the contract
• Finish date: 25 months from the commencement date excluding winter periods (15 December - 15 March)
• Guarantee period: 84 months for vertical road signs; 36 months for horizontal road signs; 60 months for all the remaining work
• Financial conditions:
  • payment – 30 days after the Contracting Authority has received a VAT invoice
  • Bank guarantee of successful execution – 5% of the approved gross contractual amount
• Contractual penalties paid by the Contractor:
  • 1. For exceeding the Deadline for the Completion of Works for reasons involving the Contractor – 0.01% of the Approved Contractual Amount per each day;
  • 2. For failure to perform the Required Minimum Performance – 0.01% of the Approved Contractual Amount per each day;
  • 3. For withdrawing from the contract for reasons involving the Contractor – 10% of the approved gross contractual amount
• Penalties paid by the Contracting Authority:
  • 1. For withdrawing from the contract for reasons involving the Contracting Authority – 10% of the approved gross contractual amount.
• The Parties reserve the right to supplementary compensation which adopts the amount of contractual penalties to the amount of damage actually suffered.

The contract value exceeds 10% of the equity of Budimex S.A.
