Signing of an Annex to the credit contract with Bank PEKAO S.A.

The Management Board of Budimex S.A. reports that on May 4, 2010 it received from Bank PEKAO SA information on signing of an annex of April 29, 2010 to Credit Contract No. 2008/268/DDF of August 12, 2008 ("Contract"). Budimex S.A. informed about this Contract and changes to this Contract in current reports no. 47/2008 and 67/2009.
Pursuant to the Annex the following amendments to the Contract were introduced:

• the limit up to which Budimex S.A. may order the Bank to issue bank guarantees from the amount PLN 300,000,000 (three hundred million zloty) up to the amount PLN 473,000,000 (four hundred andseventy three million zloty);
• the availability of the credit limit has been extended to May 31, 2011.

The collateral for the liabilities arising form the Contract are:

• Budimex S.A statement on submission to bank execution, power of attorney to administer the Budimex S.A. bank account run by the Bank.
• Other provisions of the Contract remain unchanged.

The contract value exceeds 10% of the equity of Budimex SA.
