“Construction of Wiślany sewer – stage II” – selection of the Budimex S.A. bid

The Management Board of Budimex SA announces that on 16.07.2019, Miejskie Przedsiębiorstwo Wodociągów i Kanalizacji w m. st. Warszawie Spółka Akcyjna, Pl. Starynkiewicza 5, 02-015 Warszawa informed it about the selection of the Budimex S.A. bid as the most advantageous one in the tender procedure “Construction of Wiślany sewer – Stage II”.

Bid value: PLN 348,978,963.00 net.

In the last 12 months, the total value of orders with the same Ordering Party (including the value of annexes to contracts concluded more than one year ago and the below bid) amounted to PLN 368,035 thousand net.

The highest-value order is the aforementioned bid.

Terms of the highest-value bid:

Bid value: PLN 348,978,963.00 net

Works commencement date: from the Contract date

Works completion date: 36 months from the Contract date

Guarantee period: 36 months for the completed works and 120 months for the sewer material used

Statutory warranty period: 36 months and 120 months for the sewer material used

Advance payment: 10% of the gross Accepted Contract Value.

Payment terms: 30 days from the day of delivery of a correct VAT invoice to the Ordering Party by the Contractor

Bank performance bond: 10% of the total gross Remuneration

Maximum amount of contractual penalty paid by the Contractor: 15% of the gross Accepted Contract Value

Contractual penalties paid by the Contractor do not deviate from market standards.

Penalties payable by the Ordering Party do not deviate from market standards.

The Ordering Party reserves the right to seek damages under generally applicable rules if the amount of loss sustained exceeds the amount of the stipulated contractual penalty The Ordering Party has the right to claim supplemental damages exceeding the amount of contractual penalties stipulated in this Contract, in accordance with the general principles of the Civil Code.

Other terms and conditions of the contract do not differ from the market standards.

Total value of contracts signed between Budimex and its subsidiaries and the Ordering Party, including the bid value, exceeds the threshold of PLN 147,743 thousand net.
