S6 Express Road – Task 3 – Signing of the contract

The Management Board of Budimex SA announces that on 11 June 2018 it concluded with the General Directorate for National Roads and Motorways branch in Gdańsk a contract for the construction of S6 Słupsk-Gdańsk express road on the Lębork (including Lębork bypass) - Trójmiasto bypass section, broken down into 2 parts: part 1 Construction of S6 Słupsk-Gdańsk express road on the Lębork (including Lębork bypass) – Trójmiasto bypass section Task 3 Luzino junction (without a junction) – Szemud junction (including a junction). 

The Company announced that the Ordering Party selected the Budimex S.A. bid as the most advantageous one in the tender procedure in the current report No 20/2018 of 17 April 2018.

Bid value: PLN 273,068,118.00 net

Works commencement date: from the contract date

Works completion date: 34 months from the contract date

Guarantee period: 10 years

Statutory warranty period: 60 months

Advance payment: 10% of the Accepted Gross Contract Amount

Payment conditions: within 30 days of the date of delivery of a correctly issued VAT invoice to the Ordering Party

Bank performance bond: 10% of the Accepted Gross Contract Amount.

Penalties paid by the Contractor: The total value of contractual penalties due for the Ordering Party shall not exceed 20% of the Accepted Gross Contract Amount 

Penalties to be paid by the Ordering Party: 15% of the Accepted Gross Contract Amount for withdrawal from the contract due to reasons attributable to the Ordering Party

The ordering party reserves the right to demand supplemental damages in excess of contractual penalties up to the amount of the actual loss that was incurred. The penalties are independent from one another and the Ordering Party has the right to seek payment of each of them separately.

The bid value exceeds the threshold of PLN 127,386 thousand net.
